eDava Privacy Policy
Please read this privacy policy carefully by accessing or using the App, you agree to be bound by the terms described herein and all the terms incorporated by reference. If you do not agree to all of these terms, do not use the App.
- Content & Purpose
- This privacy policy (“Privacy Policy”) applies to your use of the domain name eDava, an internet based portal, and eDava, a mobile application, owned and operated by eDava, a company duly incorporated under the provisions of the Companies Act, 2013 (hereinafter, referred to as “eDava” or “We” or “Our” or “Us” or “Firm”). The domain name and the mobile application are collectively referred to as “App”.
- The eDava is a platform that facilitates the purchase of pharmaceutical products for sale by various pharmacies (hereinafter referred to as “Services”, with the relevant pharmacies referred to as “Sellers”). The arrangement between the Sellers and eDava shall be governed in accordance with this Privacy Policy and the Terms of Use. The Services would be made available to such natural persons who have agreed to become buyers on the mobile App after obtaining due registration, in accordance with the procedure as determined by eDava, from time to time (referred to as “You” or “Your” or “Yourself” or “User”, which terms shall also include natural persons who are accessing the App merely as visitors).
- We have implemented reasonable security practices and procedures that are commensurate with the information assets being protected and with the nature of our business. Because of the inherent vulnerabilities of the internet, we cannot ensure or warrant complete security of all information that is being transmitted to us by you.
- For the purpose of providing the Services and for other purposes identified in this Privacy Policy, eDava will be required to collect and host certain data and information of the Users. eDava is committed to protect the Personal Information of the Users and takes all reasonable precautions for maintaining confidentiality of the User’s Personal Information. This Privacy Policy has been designed and developed to help you understand the following:
- The type of Personal Information (including Sensitive Personal Data or Information) that eDava collects from the Users;
- The purpose of collection, means and modes of usage of such Personal Information by eDava;
- How and to whom eDava will disclose such information;
- How eDava will protect the Personal Information including Sensitive Personal Data or Information that is collected from the Users; and
- How Users may access and/ or modify their Personal Information.
- This Privacy Policy shall apply to the use of the App by all Users / Sellers. Accordingly, a condition of each User's use of and access to the App and to the other services provided by eDava to Users is their acceptance of this Privacy policy. Any User is required to read and understand the provisions set out herein prior to submitting any Sensitive Personal Data or Information to eDava, failing which they are required to leave the App immediately.
- This Privacy Policy is published in compliance of the (Indian) Information Technology Act, 2000 and the rules, regulations, guidelines and clarifications framed thereunder, including the (Indian) Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011.
- What is the personal information?
- “Personal Information” means any information that relates to a natural person, which, either directly or indirectly, in combination with other information available with eDava, is capable of identifying the person concerned.
- “Sensitive Personal Data or Information” means Personal Information of any individual relating to password; financial information such as bank account or credit card or debit card or other payment mode details; physical, physiological and mental health condition; sexual orientation; medical records and history; any detail relating to the above as provided to or received by eDava for processing or storage. However, any data/ information relating to an individual that is freely available or accessible in public domain or furnished under the Right to Information Act, 2005 or any other law shall not qualify as Sensitive Personal Data or Information.
- Types of personal information collected by eDava:
- A User may have limited access to the App and utilize some of the Services provided by eDava without creating an account on the App. Unregistered Users can access some of the information and details available on the App. In order to have access to all the features and benefits on our App, a User may be required to first create an account on our App. As part of the registration process, eDava may collect the following categories of Personal Information from the Users (hereinafter collectively referred to as “User Information”):
- Name;
- User ID;
- Email address;
- Address (including country and postal code);
- Gender;
- Age;
- Phone Number;
- Password chosen by the User;
- Valid financial account information; and
- Other details as the User may volunteer.
- In order to avail the Services, the Users may be required to upload copies of their prescriptions, on the App and / or e-mail the same to eDava in accordance with the Terms of Use and the prescriptions will be stored/ disclosed by eDava only in the manner specified in this Privacy Policy and the Terms of Use. The term “User Information” shall also include any such prescriptions uploaded or otherwise provided by Users.
- eDava may keep records of telephone calls received and made for making inquiries, orders, or other purposes for the purpose of administration of Services.
- Internet use: eDava may also receive and/or hold information about the User’s browsing history including the URL of the App that the User visited prior to visiting the App as well as the Internet Protocol (IP) address of each User's computer (or the proxy server a User used to access the World Wide Web), User's computer operating system and type of web browser the User is using as well as the name of User's ISP. The App uses temporary cookies to store certain data (that is not Sensitive Personal Data or Information) that is used by eDava and its service providers for the technical administration of the App, research and development, and for User administration.
- eDava does not knowingly collect Personal Information from children.
- eDava may in future include other optional requests for information from the User including through user surveys in order to help eDava customize the App to deliver personalized information to the User and for other purposes are mentioned herein. Such information may also be collected in the course of contests conducted by eDava. Any such additional Personal Information will also be processed in accordance with this Privacy Policy.
- Purposes for which your information may be used by eDava:
- eDava will retain User Information only to the extent it is necessary to provide Services to the Users. The information which eDava collects from you may be utilized for various business and/or regulatory purposes including but not limited for the following purposes:
- Registration of the User on the App;
- Processing the User’s orders / requests and provision of Services (including provision of safe Services);
- Completing transactions with Users effectively and billing for the products/ Services provided;
- Technical administration and customization of App;
- Ensuring that the App content is presented to the Users in an effective manner;
- Delivery of personalized information and target advertisements to the User;
- Improvement of Services, features and functionality of the App;
- Non-personally identifiable information, exclusively owned by eDava may be used in an aggregated or non-personally identifiable form for internal research, statistical analysis and business intelligence purposes including those for the purposes of determining the number of visitors and transactional details, and eDava may sell or otherwise transfer such research, statistical or intelligence data in an aggregated or non-personally identifiable form to third parties and affiliates;
- Dealing with requests, enquiries, complaints or disputes and other customer care related activities including those arising out of the Users’ request of the Services and all other general administrative and business purposes;
- Communicate any changes in our Services or this Privacy Policy or the Terms of Use to the Users;
- Verification of identity of Users and perform checks to prevent frauds; and
- Investigating, enforcing, resolving disputes and applying our Terms of Use and Privacy Policy, either ourselves or through third party service providers.
Disclosure and transfer of your personal information:
- eDava may need to disclose/ transfer User’s Personal Information to the following third parties for the purposes mentioned in this Privacy Policy and the Terms of Use:
- To Sellers and other service providers appointed by eDava for the purpose of carrying out services on eDava’s behalf under contract. Generally these contractors do not have any independent right to share this information, however certain contractors who provide services on the App, including the providers of online communications services, will have rights to use and disclose the Personal Information collected in connection with the provision of these services in accordance with their own privacy policies.
- To our affiliates in India or in other countries who may use and disclose your information for the same purposes as us.
- To government institutions/ authorities to the extent required a) under the laws, rules, and regulations and/ or under orders of any relevant judicial or quasi-judicial authority; b) to protect and defend the rights or property of eDava; c) to fight fraud and credit risk; d) to enforce eDava’s Terms of Use (to which this Privacy Policy is also a part) ; or e) when eDava, in its sole discretion, deems it necessary in order to protect its rights or the rights of others.
- If otherwise required by an order under any law for the time being in force including in response to enquiries by Government agencies for the purpose of verification of identity, or for prevention, detection, investigation including cyber incidents, prosecution, and punishment of offences.
- eDava makes all User Information accessible to its employees and data processors only on a need-to-know basis. All eDava employees and data processors, who have access to, and are associated with the processing of User Information, are obliged to respect its confidentiality.
- Non-personally identifiable information may be disclosed to third party ad servers, ad agencies, technology vendors and research firms to serve advertisements to the Users. eDava may also share its aggregate findings (not specific information) based on information relating to the User’s internet use to prospective, investors, strategic partners, sponsors and others in order to help growth of eDava’s business.
- eDava may also disclose or transfer the User Information, to another third party as part of reorganization or a sale of the assets or business of a eDava. Any third party to which eDava transfers or sells its assets will have the right to continue to use the Personal Information and/ or other information that a User provide to us.
Retention of the information:
- All the information collected/ stored under this Privacy Policy and Terms of Use is maintained by eDava in electronic form on its equipment, and on the equipment of its employees. User Information may also be converted to physical form from time to time. Regardless of the manner of storage, eDava will keep all User Information confidential and will use/ disclose it only the manner specified under the Privacy Policy and Terms of Use.
- Part of the functionality of the App is assisting the Sellers to maintain and organize such information to effect sale and purchase of products. eDava may, therefore, retain and submit all such records to the appropriate authorities, or to Sellers who request access to such information.
- The App is also designed for assisting the Users to access information relating to pharmaceutical products. eDava may, therefore, retain and submit all such records to the relevant Users.
- eDava will also ensure that User Information is not kept for a period longer than is required for the purposes for which it is collected or as required under any applicable law.
Security practices and procedures:
- eDava adopts reasonable security practices and procedures to include, technical, operational, managerial and physical security control measures in order to protect the Personal Information in its possession from loss, misuse and unauthorized access, disclosure, alteration and destruction.
- eDava takes adequate steps to ensure that third parties to whom the Users’ Sensitive Personal Data or Information may be transferred adopt reasonable level of security practices and procedures to ensure security of Personal Information.
- You hereby acknowledge that eDava is not responsible for any intercepted information sent via the internet, and you hereby release us from any and all claims arising out of or related to the use of intercepted information in any unauthorized manner.
User's rights in relation to their personal information collected by eDava:
- All the information provided to eDava by a User, including Sensitive Personal Data or Information, is voluntary. User has the right to withdraw his/ her/ its consent at any time, in accordance with the terms of this Privacy Policy and the Terms of Use, but please note that withdrawal of consent will not be retroactive.
- Users can access, modify, correct and delete the Personal Information provided by them which has been voluntarily given by the User and collected by eDava in accordance with this Privacy Policy and Terms of Use. However, if the User updates his/ her information, eDava may keep a copy of the information which User originally provided to eDava in its archives for User documented herein. In case the User seeks to update or correct, his/ her Personal Information, the User may exercise these rights by emailing eDava at syldetpharma@gmail.com
- and communicate the change(s) for updating eDava’s records.
- If a User, as a casual visitor, has inadvertently browsed any other pages of this App prior to reading the Privacy Policy and the Terms of Use, and such User does not agree with the manner in which such information is obtained, stored or used, merely quitting this browser application should ordinarily clear all temporary cookies installed by eDava. All visitors, however, are encouraged to use the "clear cookies" functionality of their browsers to ensure such clearing/ deletion.
- If a User has inadvertently submitted any Personal Information to eDava prior to reading the Privacy Policy and Terms of Use, and such User does not agree with the manner in which such information is collected, stored or used, then such User can ask eDava, by sending an email to syldetpharma@gmail.com
- containing the rectification required, whether eDava is keeping Personal Information about such User, and every User is also entitled to require eDava to delete and destroy all such information relating to such user (but not other Users) in its possession.
- In case the User does not provide his/ her information or consent for usage of Personal Information or subsequently withdraws his/ her consent for usage of the Personal Information so collected, eDava reserves the right to discontinue the services for which the said information was sought.
- Liability and Indemnity
1. eDava does not warrant that the App or any of the Services or Products available through it will be uninterrupted or free from errors. There may be delay, omissions, interruption, and/or inaccuracies in materials or Service available through App.
2. eDava makes no representation or warranties about the accuracy, completeness, timeliness, reliability, or non-infringement of any content on the App or Services available through it.
3. Although eDava takes reasonable steps to prevent the introduction of viruses, worms or other malicious code to App, eDava does not represent or warrant that the App, or the Service or Products or materials that may be made available through App are free from such destructive features. eDava is not liable for any damages or harm attributable to such features or arising directly or indirectly from such features.
4. In no event shall eDava be liable to you or to any third party for any direct, incidental, indirect, special or consequential losses, damages whatsoever (including, but not limited to, lost profits, business interruption, loss of programs or other data on your information system), even if eDava has been advised, knew, or should have known of the possibility of such damages, arising out of or related to: (i) your use of or reliance on App , any information, hyperlinks or content contained therein, or Services included on or otherwise made available to you through App ; (ii) your provision of information, personal or otherwise, to eDava; (iii) the provision of Services by eDava; or (iv) acts or negligence on the part of eDava, its agents or employees.
5. TO THE FULLEST EXTENT PERMITTED BY LAW, eDava DISCLAIMS AND EXCLUDES ALL WARRANTIES AND REPRESENTATIONS, EXPRESS, IMPLIED OR STATUTORY, WITH RESPECT TO THE APP OR eDava’S SERVICES, OR WITH RESPECT TO THE ACCURACY, CURRENCY OR COMPLETENESS OF THE INFORMATION PROVIDED BY eDava, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILTY OR FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT OF A PATENT, TRADEMARK OR OTHER INTELLECTUAL PROPERTY RIGHT. THE APP, INCLUDING, WITHOUT LIMITATION, ALL CONTENT, INFORMATION AND LINKS CONTAINED THEREIN, IS PROVIDED “AS-IS” WITHOUT ANY WARRANTY THAT IT WILL BE UNINTERRUPTED OR ERROR FREE. YOU EXPRESSLY AGREE THAT YOUR USE OF THIS APP IS AT YOUR SOLE RISK.
6. Notwithstanding anything herein to the contrary, eDava’s aggregate liability (whether in contract, tort or otherwise) for any loss or damage that you may incur on any account whatsoever, arising out of your use of the App, shall be limited to a sum equal to the amount paid or payable by you for the Product(s) in respect of one incident or series of incidents attributable to the same cause.
7. eDava reserves the right to refuse Service, terminate Accounts, remove or edit content, or cancel orders anytime at their sole discretion.
8. By using App and/or the Service, you agree, to the fullest extent permitted by law, to indemnify and hold eDava, its directors, officers, employees, affiliates, agents, contractors, and licensors harmless with respect to any claims arising out of your breach of these Terms, your use of App or the Service, your non-compliance with applicable law or regulations in the jurisdiction in which you are accessing App or the Service, or any action taken by eDava as part of its investigation of a suspected violation of these Terms or as a result of it’s finding or decision that a violation of these Terms has occurred.
- Miscellaneous Provisions
1. Your use of the App and the contract between you and eDava shall be governed by the law of India, without regard to the conflict of law rules and any dispute between you and eDava will be only resolved exclusively in the Courts at Hyderabad, India but not in any other Court.
2. We have selected the Products on the basis that they will be used for personal use only. If you are planning to use them for business purposes you are advised to make sure that you are covered by a proper insurance plan. Where you decide to use the Products in the course of a business, we exclude (to the fullest extent permitted by law) those warranties and conditions relating to fitness for a particular purpose. Our maximum liability to business users arising out of or in connection with the Products shall be limited to the replacement value of the Product in question. In relation to business users, we do not accept liability for the fitness of Products for business purposes, nor do we accept liability for loss of use of the Product, nor any loss over and above the cost of the Products in the event of a claim for breach of warranty or condition.
3. eDava shall be under no liability for any delay or failure to deliver Products or otherwise perform any obligation as specified in these Terms if the same is wholly or partly caused by events of Force Majeure and/or caused, whether directly or indirectly, by circumstances beyond its reasonable control. For the avoidance of any doubt, Force Majeure events shall, without being limited, mean and include events of war, riots, civil war, rebellion, earthquake, cyclones, flood or any other natural physical disaster and/or acts of God.
4. Any links or references to other Internet App’s (“hyperlinks”) contained on App are provided by eDava merely as a convenience to users of App and eDava is not responsible for the content or operation of any such linked Internet sites. Any hyperlinks to such linked Internet sites should no way be construed as an endorsement, representation or promotion by eDava as to the content, representation, accuracy, products or services found or otherwise described in such linked Internet sites. Use of those linked Internet sites/hyperlinks is done at your own risk and cost.
5. You agree that you will not assign, transfer, or sub-contract any of your rights or obligations under these Terms or any related order for Products to any third party, unless agreed upon in writing by eDava.
6. eDava reserves the right to transfer, assign or sub-contract the benefit of the whole or part of any of its rights or obligations under these Terms or any related contract, to any third party.
7. If any part of these Terms is held by any competent authority to be invalid or unenforceable in whole or in part, the validity or enforceability of the other Terms shall not be affected.
8. These Terms do not create or confer any rights or benefits enforceable by any person that is not a party.
9. No delay or failure by eDava to exercise any powers, rights or remedies under these Terms will operate as a waiver of them nor will any single or partial exercise of any such powers, rights or remedies preclude any other or further exercise of them. Any waiver to be effective must be in writing and signed by an authorized representative of eDava.
10. These Terms including the documents or other sources referred to in these Terms supersede all prior representations, understandings and agreements between you and eDava relating to the use of App (including the use of Services and/or order of Products) and sets forth the entire agreement and understanding between you and eDava for your use of App .
11. When you visit App or send e-mail to us, you are communicating with us electronically. You consent to receive communication from us electronically. We may communicate with you by e-mail or by posting notices on App. You agree that all agreements, notices, disclosures, and other communication that we provide to you electronically satisfy any legal requirement that such communication be in writing.
- Changes in the privacy policy:
- eDava may update this Privacy Policy at any time, with or without advance notice. In the event there are significant changes in the way eDava treats User's Personal Information, eDava will display a notice on the App or send Users an email. If a User uses the Service after notice of changes have been sent to such User or published on the App, such User hereby provides his/ her/ its consent to the changed practices.
